Privacy policy

This policy covers the hernandestech.com website, business contact, and the projects we deliver for clients.
Who is responsible
Isaque Hernandes Freitas de Santana Tecnologia da Informação Ltda, a company registered in Brazil under CNPJ 38.003.112/0001-79, trading as Hernandes Tech.
The company acts as controller for the data described under Website and Contact below. The data protection channel is privacy@hernandestech.com.
Website
The site is static. It uses no cookies, loads no third party scripts, has no analytics tooling and builds no visitor profile.
Our hosting provider may record technical access data, such as IP address, date and time, page requested and browser type, as a normal part of running and securing any web server. Those logs belong to the hosting provider, are kept for a short period, and are not used by us to identify visitors.
Contact
When you write to us we receive your email address, whatever name is in your signature, and whatever you tell us in the message.
- Purpose. To reply to you and to run the commercial conversation.
- Legal basis. Performance of a contract or pre contractual steps under GDPR Article 6(1)(b) and LGPD Article 7, V, or legitimate interest in answering a contact you initiated under GDPR Article 6(1)(f) and LGPD Article 7, IX.
- Retention. We keep the correspondence for as long as the relationship lasts and for up to 5 years afterwards, in line with contractual limitation periods.
- Sharing. None. We do not sell, trade or pass on contacts.
Client projects
When we build software for a company, we commonly get access to systems and databases containing personal data about that company's customers, staff or users. In that situation the client company is the controller and Hernandes Tech acts as processor. We handle the data only on the client's instructions and only as far as needed to carry out the contracted work.
- We access the minimum necessary, and work with test or anonymised data wherever possible
- We never use client data for any purpose of our own, including model training
- At the end of a project we return or destroy working copies and hand back access, as the client directs
- Where the contract requires it, we sign a specific data processing agreement
Sub processors
To operate we use third party services such as hosting, email and source control. Those providers may process contact or project data to the extent needed to deliver their service. We select providers with their own data protection commitments, and we tell a client when a sub processor is relevant to their project.
International transfers
Some of those providers keep servers outside Brazil. Where that happens, the transfer relies on the mechanisms set out in Article 33 of the LGPD and, where applicable, on the standard contractual clauses of the GDPR.
Security
We apply technical and organisational measures proportionate to the size of the operation. Among them, individual credentials, two factor authentication on services that support it, encryption in transit, and least privilege access on anything a client grants us.
No system is immune. In the event of an incident with material risk, we notify affected individuals and the relevant authority within the statutory deadlines.
Your rights
The GDPR and the Brazilian LGPD give you the right to confirm whether we process your data, access it, correct it, request anonymisation or deletion, withdraw consent and object to particular processing. UK and California residents have equivalent rights under their own laws.
To exercise any of them, write to privacy@hernandestech.com. We respond within 15 days.
If the data sits inside a system we built for a client, we forward the request to that client, who is the controller, and we support them technically in answering it.
Changes
Changes to this policy are published on this page with a new effective date. Material changes are emailed to active clients.
